Terms and Conditions for 8611 La Isla Drive, Emerald Island Resort.

 
Bookings
 
Price includes reasonable use of utilities such as water, heat, electric, trash removal, telephone and cleaning on departure, but does NOT include flights, car hire, holiday insurance, nor pool heating or hot tub/spa heating (unless by agreement with the owner) Prices are subject to currency fluctuations and government action.
 
Booking Deposit
 
You are required to pay a deposit of $300 / £200 or 20% whichever is the greater per booking. Once the booking is confirmed the deposit will be non-refundable but will be deducted from the full amount due.
 
Balance
 
The outstanding balance is due 60 days before the arrival date. If you book our home less than 60 days before your arrival date the full balance will be due immediately.
 
Payment
 
The preferred method of payment is with your credit card via Paypal for your own security. Payment by Paypal or credit card may include a charge for the transaction. Cheques are also accepted
 
Security Deposit
      
Upon payment of the outstanding balance, the client shall be required to pay a refundable security deposit of $300 / £200 which must be paid along with your final balance by you regardless of the length of your stay. This is to guard against any possible damage / breakages / loss / excessive cleaning to the property that may be incurred during your rental period.
      
Guests using our home are responsible for all damage and missing inventory items or loss occurring during their stay and the cost of repair / replacement. This liability is not limited to the security deposit amount. It is important that guests check our home on arrival and report any problems or deficiencies to the management company within 24 hours of arrival.
 
The deposit will be refunded to the client as soon as possible and no later than 10 days after the client has vacated the property, less the cost of any breakage’s, or damage caused during the period of rental in accordance with the managers report.
 
Arrivals / Departure
 
Clients will be given instructions on how to access the house 7 days prior to arrival. Clients may gain access to the property after 4.00 pm on the arrival date, and must vacate before 11.00 am on the departure date, unless by prior arrangement with the owner. Failure to vacate the property by this time may result in additional charges.
 
Cancellation
 
We reserve the right to treat the booking as cancelled if we do not receive the balance by the due date. Cancellation must be in writing by the party leader. For most reasons beyond your control cancellations will be covered by your travel insurance.
      
In the unlikely event that due to circumstances beyond our control we need to make changes or cancel your booking, we will inform you as soon as possible. We reserve the right to cancel any bookings at any time, and will only be held liable to refund monies already paid by you the client. Alternatively we reserve the right to offer similar accommodation.
 
In the event of cancellation the following charges will normally apply:

Pool Safety
 
Guests using the pool or its surrounding areas do so at their own risk. The owners their servants or agents will accept no responsibility for any loss or personal injury incurred from using the pool or its surrounding areas.
 
Children are required to be supervised at all times when using the pool or on the pool deck area.

The pool safety fence must be kept erected at all times for the safety of children.
 
Items such as clothes and toys etc. must not be left in the spa. 
 
The pool is cleaned and chemically balanced every week for your safety and comfort. However, on rare occasions it may be necessary to apply extra chemicals to the pool to maintain safe and correct chemical levels. Should this occur during your stay it may be necessary for you to be out of the pool for a period of 12-24 hours for safety reasons.
 
If you have requested pool heating, the temperature is subject to prevailing weather conditions, etc. The pool cover must be used to retain the heat when the pool is not in use and especially overnight and this is the responsibility of the guest at the time.
 
Security
   
All doors and windows must be closed and any security alarm at the property must be set whenever you are not in the property. Guests are responsible for closing all doors and windows and for setting the security alarm.
 
Trash

Please follow these few simple rules and you will be assisting us to keep the community clean and tidy for others to enjoy.

Trash is collected on Monday and Thursday mornings after 7.00 a.m.

All household garbage must be placed into suitable garbage bags and tied and placed inside the trash can(s)

Do not place loose articles into the trash cans.

Do not leave any excess alongside the cans. Remember, a plastic bag or cardboard box is no match for raccoon’s claws or other nocturnal visitors.

No loose or bagged trash must be left outside the cans.

The trash cans with their lids secured should be placed at the end of the drive (kerbside) either the night before or on the morning of collection before 7.00 a.m.

Once emptied, wheel the cans away to the side of the home as soon as possible. Please do not leave the trash cans at the kerbside.

If you find that you have produced copious amounts of garbage which could cause an overflow in the garbage can, then this excess can be disposed of efficiently and properly by taking it to the Compactor site within the community and placing into the Compactor situated 
adjacent to the tennis courts

Failure to comply with the above could lead to a charge being made against your security deposit.

Force Majeure
   
The owners or agents will not be liable for loss or delay occasioned by strikes, riots, political unrest, hostilities, war, terrorist activity, industrial disputes, fire, flood, technical / weather, problems with transport, aircraft grounding, closure of airports. If your booking needs to be terminated prior to the scheduled conclusion of your booking your travel insurance may cover you for these events
 
Noise
 
You will take care not to play excessively loud music or otherwise create a nuisance to the neighbours
  
Insects
   
Florida is a tropical state and insects such as ants and the like are occasionally inevitable and are not a cause for complaint. The villa is treated periodically as part of a pest and termite control programme and are also professionally cleaned.
 
Smoking
   
Smoking is not allowed.
 
Animals
   
Animals/pets are strictly not permitted (unless approved by owner).
 
BBQ
 
A BBQ is available if requested at the time of booking. It is the clients responsibility to properly clean the equipment after use, as there will be a charge of $50 for failure to do so.
 
It is the clients’ responsibility to have the gas cylinder changed by contacting the management company.
 
Access
 
The client is to allow the owner or their agents the right to enter the property to carry out any maintenance.
 
Liability
 
You are advised that you are occupying a private villa and therefore are responsible for your own safety in respect of any loss, personal accidents or damages sustained by you or any members of your party during your stay. It is the guests responsibility to ensure that they have adequate holiday insurance to cover personal injury/ accidents /damage. The owners or their agents of the property will accept no claims whatsoever.
The owner or their agents accept no liability for loss of mains services or failure of appliances or of any actions taken in the vicinity of the property by any authority or third party persons beyond their control.
 
Insurance

Clients are strongly recommended to take out adequate holiday insurance to cover cancellation, accident/illness or damage.
 
Breach of Booking Conditions
 
The management company reserve the right to remove occupiers from the premises (without refund) for breaching the booking conditions.
 
Satisfaction
 
If for any reason you are dissatisfied with your vacation home then please make contact with the owner or the management company at your earliest convenience so that the problem can be resolved as soon as possible.
